The need to create an autopoietic brazilian environmental jurisdiction

The lack of effectiveness of environmental law does not correspond to the importance that this branch of law has for our society and for the future of man on earth. Environmental issues are still little valued in Brazilian society, and this is often aggravated by the way they are dealt with by legal operators. This article analyzes the need to create an autopoietic Brazilian environmental jurisdiction, arguing that the current judicial structure lacks the specialization and autonomy necessary for the effective protection of the environment. Through a critical bibliographical review and analysis of data from environmental public civil actions, the study demonstrates the fragmentation and inefficiency in resolving environmental conflicts in Brazil. The research argues that the creation of an autopoietic environmental jurisdiction, with specialized judges, specific courts and autonomy to develop its own rules and procedures, will strengthen the application of environmental legislation, making environmental protection more effective.
