Technical–Legal Methodology and Italian Fascist Criminal Law: Contributions of Alfredo Rocco and Arturo Rocco

This study aims to analyze how the development of the Italian technical-legal methodology contributed to the rise of fascism in Italy, without requiring any modification to the existing criminal legislation or the scientific foundations of criminal law. The article is fundamentally grounded in the study of law, legal history, and sociology, and employs the following methodological tools: (i) a bibliographic review on primary sources by Alfredo Rocco and Arturo Rocco, regarding fascism and the Italian penal science structured by the technical-legal methodology. In addition, several Italian contemporary authors were used to interpret them; (ii) documentary analysis, covering the period from 1910 to 1940, of the following Italian legal journals: Rivista di diritto e procedura penale, Rivista Italiana di Diritto Penale, and Annali di Diritto e Procedura Penale. As a result, it is concluded that the legal-technical methodology was a key element in maintaining the criminal legal order and the foundation principles of classical criminal law, despite the presence of exceptional legislation during the Fascist period in Italy. Finally, this study contributes to the state-of-the-art research on criminal law under Fascist rule in Italy, bringing authoritative Italian perspectives to Brazil.
