Civil liability and curatorship: the Statute of the Disabled Person and its impact on the curator's civil liability

Abstract

The aim of this research is to analyze the impact of the statute for people with disabilities on the civil liability of the curator. Compared to the Bevilaqua Code, the Reale Code kept the hypotheses of indirect civil liability identical, changing only the type of liability because, in order to make it easier for the victim to obtain compensation, it enshrined objective civil liability in article 933. Among the hypotheses of indirect civil liability, in the list provided for in article 932 of the Reale Code, is that of the curator for damage caused by the curate. Nonetheless, the Statute of the Person with Disabilities, with the aim of promoting the full inclusion of all disabled people, conferred the rule of full civil capacity on them, increasing their autonomy to carry out the acts of civil life. The expansion of the disabled person's autonomy, on the other hand, has reduced the interference of their curator in their private life, which, in theory, removes their authority and also influences the extent of their responsibility. It concludes that the Statute for Persons with Disabilities has altered the curator's civil liability regime. The method used is hermeneutic, based on an analysis of legislation, doctrine and case law.
