The constitutional reforms on judicial matters of 2024: reflections on successes, failures and the unconventionality of their contents regarding constitutional control mechanisms

Abstract

The constitutional reform to the Judiciary, published in the Official Gazette of the Federation on September 15, 2024, has transformed the way in which jurisdictional bodies are integrated and has made substantial modifications in matters of unconstitutionality actions, constitutional controversies and amparo proceedings. The purpose of this work will be to critic reflect on its scope, on what are considered to have been successes and/or failures; and, precisely speaking of failures, supported by dogmatic, legal, exegetic and case study methods, the unconventionality of the section of said reform in matters of unconstitutionality actions, constitutional controversies and amparo proceedings will be demonstrated argumentatively, given that the principle of progressivity of human rights is violated, as well as judicial guarantees and the right to a simple, rapid and effective remedy. In this part, an analysis of the constitutional reform will be added on the unchallengeable of the constitutional reforms, also issued in 2024.
