A study on earnest money (arras), the penal clause, and the issue of the cumulation of these institutes

The present study aims to contribute to the systematization of the discipline of earnest money (arras) and penalty clause in the context of contractual default. To achieve this goal, a historical, functional, and comparative analysis of both institutes will be conducted. In turn, based on the analysis of the decision issued by the Third Chamber of the Superior Court of Justice (STJ) in the judgment of Special Appeal (REsp) No. 1.617.652/DF, the possibility of cumulating the studied institutes in the context of contractual damages is verified. Finally, an analysis is made of which of the two figures should prevail in abstract as a penalty to the defaulting debtor, in the case of coexistence.
