Ancestral memory as an instituint element of right:
A possible debate between Krenak and Sánchez Rubio

This article discusses the relationship between ancestry and the struggles for the establishment of the rights of Indigenous and Quilombola peoples, seeking to connect ancestral knowledge with a critical theory of human rights. The notion developed in Krenak’s work serves as a source of connection between ancestry, memory, and the struggle for rights, which allows us to engage with the instituting dimension of human rights as presented in the work of David Sánchez Rubio. We propose that ancestry functions as a relational factor of emancipation, capable of constituting new rights and safeguarding a plural conception of ways of living. The dialectical method is employed, through which we contrast the modern capitalist worldview with the epistemology of Indigenous peoples and communities.
