Abstract

The research presented here aims to examine the limits and possibilities of the Judiciary's actions in conflicts that fundamentally involve the protection of the right to housing. To conduct the investigation, the hypothetical-deductive method was used, adopting a multiple approach that integrates quantitative and qualitative procedures, through descriptive research, based on bibliographic and documentary techniques, with data collected through Boolean research applied in the search for case law in the databases of the Court of Justice of the State of Piauí and the Federal Supreme Court, structured and interpreted based on thematic content analysis. Initially, it delved into the explanation of the right to housing in this context of judicialization, highlighting the main objections to its implementation by the Judiciary and, in the end, focused on the position of the Court of Justice of the State of Piauí and the Federal Supreme Court regarding the theses of the reserve of the possible and the separation of powers. The latter posits that state power should be divided into three distinct spheres to prevent the concentration of power and protect citizens' freedom. The former concerns the understanding that the effectiveness of social rights is conditioned on the financial capacity of the State, since such rights depend on resources derived from the public budget. The main objections concerned the costs and the lack of available resources, as well as questions regarding the lack of knowledge and democratic legitimacy of this adjudicating body. Furthermore, it was found that the courts have adopted interpretations of the legislation compatible with the full realization of the right to housing.
