Derecho y biopolítica: el sueño de conciliar ley y orden

Abstract

The debate on the place of law in the forms and technologies of power in contemporary societies developed by Michel Foucault generated a confrontation in the Anglo-Saxon field between those who argued that Foucault underestimated or minimized the role of law in his analysis and those who defended its centrality. Our proposal is to revisit this debate, arguing that the key to resolving it is rooted in the postulate about the antinomy between law and order that Foucault establishes in the framework of the analysis of governmentality. Through the history of governmentality initiated by Foucault at the end of the 1970s, our work follows the different transformations of law characterized by the author, situating them subsequently in the antinomy between law and order. This analysis makes it possible to clarify what was the general plan not carried out by Foucault in the course of The Birth of Biopolitics and to relate the diagnosis of the crisis of justice and the crisis of governmentality that Foucault enunciated at the end of the 1970s. The path followed will also make it possible to situate Foucault's allusions to the “rights of the governed” as a correlative strategy to liberal and neoliberal governmentality that would put a limit to its excesses.

 Ha sido docente en la Universidad de Barcelona, en la escuela Massana de Artes y Diseño de Barcelona y en la Universitat Oberta de Catalunya. Es licenciada en Psicología por la Universitat Rovira i Virgili y licenciada y doctora en Filosofía por la Universidad de Barcelona, con una tesis sobre Michel Foucault. Su investigación se centra en el ámbito del pensamiento crítico contemporáneo. Ha publicado el libro Michel Foucault: biopolítica y gubernamentalidad (Gedisa, 2021) en el marco de la colección .
