Reconhecimento do direito à adoção por casais homossexuais: um estudo de direito comparado entre Brasil, Argentina e Uruguai

This article aims to analyze the process of recognizing the right to adoption by homosexual couples based on a comparative study between Brazil, Argentina, and Uruguay. It is known that in Brazil, Argentina, and Uruguay, homosexual couples already have the right to adoption fully recognized. However, only in Brazil did the process of recognizing the right in question occur through the judiciary, instead of the legislative route, which possibly made this process even more complex and slow. The research not only confirms Brazil's delay in relation to its neighboring countries but also reveals the difficulties faced by the Brazilian LGBTQIAPN+ population in obtaining legal protection, without any support from the Legislative. The methodology used was a qualitative approach, supported by the bibliographical review of literary works about LGBTQIAPN+ rights, Family Law, and Children’s Rights, as well as the analysis of legislation and jurisprudence pertinent to adoption by homosexual couples, in national and international scope. As a theoretical reference, the works of Dias (2016) and Rios (2020) were used, among other authors. The study is useful for the science of law when discussing perspectives for the future, within the scope of LGBTQIAPN+ sexual rights, beyond the familiarist view.
