In 2023, the Maria da Penha Law celebrated its 17th anniversary, a sufficient period for its main concepts to be understood by the legal system. However, decisions from various Brazilian courts express resistance to the incorporation of the gender paradigm and misunderstanding of the concept of gender-based violence. Through a literature review of research on the interpretation of the Maria da Penha Law, this article aims to provide evidence of a trend towards restrictive interpretations by courts regarding the concept of gender-based violence when granting protective measures. This trend increases obstacles to women's access to justice, violating the Maria da Penha Law, conventions, and recommendations of international mechanisms for the protection of women's human rights.
