Application of land regularization in informal urban areas as a mechanism for the realization of fundamental rights

Abstract

This research deals with the land regularization of social interest in a drinking water catchment area for urban supply in a medium-sized city. It aims to analyze the REURB-S, instituted in a permanent preservation area, focusing on the equalization of the fundamental rights of housing and balanced environment, from the rules established by Law No. 13,465/2017. The object of study refers to the reality of the subdivision Caçador, municipality of Chapecó (SC). The methodological procedure used documentary research, based on information from the municipal government of Chapecó, combined with interviews, applied to a public manager and a community representative. As results, it was possible to analyze the context of the regularization of informal areas, based on the preservation of the environment and quality of life for the inhabitants, enabling the exercise of the right to property, as well as an orderly urbanization that can progressively be a lever of social and urban integration. Finally, these actions, even if occasional, due to the widespread urban demand for regularization, already represent a social gain by the potential of being replicated in similar urban realities and spread throughout the municipal territory.
