Abstract

Objectives: The overall objective is to understand the structural causes of this fragility and, based on them, to propose a methodological model capable of guiding scientific research in Law. The specific objectives include: identifying the historical and institutional elements that shaped Brazilian legal rationality; analyzing the convergence of criticisms formulated by national and Latin American authors; and constructing a methodological proposal inspired by Popper's critical rationalism.

Methodology: The methodology is essentially bibliographic, based on authors who, since the 1980s, have analyzed the dogmatic formation and epistemological insufficiency of the legal field.

Results: The investigation critically organizes these contributions, identifies recurring patterns, and formulates a methodological proposal supported by the Popperian scheme P1–TE–EE–P2, integrating logical and empirical tests.

Contributions: As a contribution, the text offers a comprehensive diagnosis of the scientific fragility of Law and presents an operationalizable model for reconstructing legal research on critical, testable, and intersubjective bases, strengthening the constitution of Legal Sciences in a strong sense.
