The diversity of juridical foundations and experiences: Étienne Le Roy’s notion of juridical tripod

Abstract

This paper aims to explore the issue of the diversity of the juridical experience, drawing on French anthropologist Étienne Le Roy's notion of juridical tripod. It employs a bibliographical method of research, gathering references from the field of legal anthropology, from within anthropology itself or from related fields, with emphasis on Le Roy's texts. The results are demonstrated in an argumentative sequence that encompasses a non-ethnocentric understanding of law, the dimensions of juridicity, the sanctionability of juridicity, the assemblies of juridicity, and the juridification of habitus in Le Roy's proposal, the durable dispositions systems. In summary, it indicates that the foundations of juridical regulation are not limited to the norm, just as law does not represent the totality of juridical regulation. Juridical regulation exists everywhere, but its form varies by culture. This paper contributes to the recognition of a proposal that confers high epistemological potential for the general analysis of juridical phenomena. Additionally, it encourages the acceptance of diversity, a fundamental stance at a time when there is no longer any escape from interculturality.
