Libertarian mitigated paternalism? Reflections regarding ARE No. 1,309,642

Libertarian paternalism and its strategies of minimal intervention in private autonomy have been gaining ground in Brazil, following a growing interest in behavioral economics studies driven by Israeli and American Daniel Kahneman. Having originated in the 1950s, the criticisms and concerns of behavioral economics about the possibility of directing individual will are still in an early stage of debate in Brazil. This article seeks to contribute to this debate by analyzing the judgment of Interlocutory Appeal in Extraordinary Appeal No. 1,309,642. In it, the Federal Supreme Court gave an interpretation in accordance with the Constitution to art. 1,641, II of the Civil Code, transforming the regime of mandatory separation of assets for septuagenarians into a standard rule, safeguarding the possibility of opting for an alternative regime through a public deed. As a result, it was possible to extract from the judgment the STF's preference for a less intense state paternalism rather than a strong and coercive paternalism, but there was no confrontation with critical and ethical issues involving nudge strategies. The research methodology is bibliographic through the review of existing literature on the topic.
