Law, state and ideology: notes on the perspectives of Claude Lefort and Louis Althusser

Objectives: The objective of this article is to analyze the way in which Claude Lefort and Louis Althusser, based on their reflections on ideology, conceive law and the State. To do so, firstly, it focuses on the general aspects of these two authors’ thoughts about ideology. It then examines the Althusserian theory of “ideological State apparatuses” to, from there, approach law as one of these “apparatuses”. Having done this, it analyzes the ambivalent character of Claude Lefort’s conception of law and the State. The comparison of aspects of the reflections of these two authors gives rise to the possibility of apprehending different conceptions of law and the State within the scope of political philosophy.
Method: Based on the hypothetical-deductive method, an argumentative approach is developed that contrasts the reflections of the two authors analyzed through research into bibliographic sources.
Results: The contrast between the thoughts of Louis Althusser and Claude Lefort allowed us to identify two distinct views on law and the State, based on the concept of ideology. The comparison of aspects of the reflections of these two authors gives rise to the possibility of apprehending different conceptions of law and the State within the scope of political philosophy.
Contributions: The article aims to provide a contribution to the understanding of law and the State in light of the concept of ideology, based on the works of Louis Althusser and Claude Lefort.
