Resumo:

As ideologias atuam na formação dos sujeitos ligados ao campo jurídico de um modo fundamental para a reprodução da formação social. É por meio das ideologias que os sujeitos tomam consciência dos conflitos em que estão envolvidos e se posicionam em relação a eles, normalmente aderindo a uma perspectiva de conservação da ordem posta, que é dominante no âmbito jurídico. No entanto, também aqui há espaço para outras orientações ideológicas, que entram em embate com a defesa da ordem, buscando transformá-la, seja no sentido de uma reforma, seja no sentido da sua superação. O quadro analítico em que se apóia as reflexões do trabalho situa-se na tradição marxista – sobretudo nas formulações de Karl Marx, Gyorgy Luckács e István Mészáros –, buscando identificar e destrinchar estas perspectivas ideológicas contrapostas no campo jurídico. Em termos metodológicos, a opção pelo materialismo histórico busca compreender como essas forças contrárias se forjam nos reais embates que têm de travar no interior deste campo em que elas incidem, a partir de experiências concretas analisadas dentro do contexto da educação jurídica.

Abstract:

Ideologies operate in the formation of subjects related to the juridical field in a fundamentally important way for the reproduction of the social formation. It’s through ideologies that subjects become aware of the conflicts in which they are involved and take positions regarding them, usually joining a perspective of conservation of the established order, which is dominant in the juridical sphere. However, here too there is room for other orientations, which challenge the defense of the order, seeking to transform it, either in terms of reforming it, or in terms of overcoming it. The analytical framework which supports the reflections of this work is found in the Marxist tradition – mainly in the formulations of Karl Marx, Gyorgy Luckács and István Meszáros -, seeking to identify and unravel these opposing ideological perspectives in the legal field. In methodological terms, the option for the historical materialism seeks to understand how these opposing forces forge themselves in the real battles that they must fight within this field they affect, from concrete experiences analyzed within the context of legal education.
