Resumo
O artigo objetiva apontar que, dentre os fatores de violações aos direitos dos indígenas, está uma incompreensão, por membros dos tribunais, das ontologias de tais povos. Metodologicamente, baseia-se em levantamento bibliográfico interdisciplinar e em Análise Crítica do Discurso de duas decisões do Superior Tribunal de Justiça. Ambas revelam equívocos sobre uma vida não ocidental.

Abstract
The paper aims to point out that, among the factors of violations of the rights of indigenous peoples, is a misunderstanding by members of the courts about the ontologies of such peoples. Methodologically, the text is based on interdisciplinary bibliographic research and on Critical Discourse Analysis of two decisions of the Superior Court of Justice. Both decisions reveal misconceptions about a non-Western life.
