The article intends to develop a theoretical reflection focused on the approximation between the Pachukanian reading of the legal form and the Marxist theory of dependence, considering, in a subordinate way, other attempts to characterize the nature of the relations of production present in the Brazilian social formation. The guiding thread of our analysis is the search for the improvement of the “research problem” posed by Ricardo Prestes Pazello about the dependent character of Latin American social formation and the effects that dependence has on legal subjectivity, which we will do based on the relationship between legal form and social formation.
