Resumo
Esse artigo trata do direito de transexuais femininas utilizarem banheiros femininos. Diante da relevância constitucional reconhecida pelo Supremo Tribunal Federal, procede-se, com o aporte do debate jurídico estadunidense, à análise dos argumentos invocados, concluindo-se pelo direito à utilização de banheiros públicos femininos por transexuais femininas e pela incompatibilidade de alternativas que proponham banheiros específicos para transgêneros.

Abstract
This paper is about transgender women's right to access public bathrooms which correspond to their gender identity. In light of the constitutional relevance recognized by the Federal Supreme Court, and considering the legal debate in the U.S., it proceeds to the analysis of the arguments presented, reaching the conclusion that transexual women have a right to use the women’s bathroom, and that the alternatives which propose the creation of specific bathrooms for transgender people are unsuited.
