Resumo
Parafraseando o questionamento que Boaventura de Sousa Santos adota como título do artigo “Poderá o direito ser emancipatório?”, o presente ensaio propõe-se a revisitar o referido texto, baseado, principalmente, em outra obra do mesmo autor, denominada “Para além do pensamento abissal: das linhas globais a uma ecologia de saberes”. Transpõe as ilações feitas para um diálogo com a sua concepção de “constitucionalismo transformador”, para indagar se poderá haver espaço para a emancipação na Justiça Criminal brasileira. Formulamos uma resposta positiva baseada na postura contra-hegemônica de alguns magistrados ao analisar questões penais à luz da Constituição Federal de 1988.

Abstract
Paraphrasing the question Boaventura de Sousa Santos adopts as title of the article “Can Law be Emancipatory?”, this essay proposes readdressing the text mentioned, based, mainly, in another work from de same author named “Beyond Abyssal Thinking: from Global Lines to Ecologies of Knowledges”. It transposes the conclusions achieved into a dialogue with his concept of “transformer constitutionalism” to question if there could be space in Brazilian Criminal Justice to emancipation. We respond it positively based on some judges counter-hegemonic posture while analyzing criminal issues in the light of 1988 Federal Constitution.
