Mediazione civile obbligatoria, l’esperienza italiana. Il “Correttivo” 25.01.2025. Ulteriore passo avanti

The relationship between Italians and civil justice has not always been the easiest and mediation, at least formally, has always been present in the Italian legal system, except in the period 1922/1945.
In 2010, mandatory civil mediation was introduced, i.e. a condition of admissibility. Protests, criticisms, dismay. However, even if slowly, it has grown and finally, in the Italian Official Journal of 10.01.2025, Legislative Decree 27.12.2024, n. 216, (long awaited and) called “Corrective” was published. In fact, it introduces very interesting changes to Legislative Decree 10.10.2022, n. 149 (Cartabia Reform), which brought changes to one of the basic acts of the Italian legislation on mediation, Legislative Decree 28/2010, already the subject of numerous interventions over the years.
The numbers, relating to articles of law and paragraphs, indicated in this article, refer to the articles not of the "corrective" but of Legislative Decree 28/2010 amended by the "Corrective".
