PROCEEDINGS BY HEARINGS IN THE CONFLICTS INVOLVING INDIGENOUS COMMUNITIES

The neglect involving the indigenous community in Latin America is a claim's target since the revolution of May 1810. In addition, the critical situation in which the conflicts that cross the lives of such communities are multiple and diverse. From this universe of cases, we will analyze the assumption of conflicts that can be submitted to ordinary justice through a proceeding by hearings. In this sense, we will explore the convenience of its use and whether the proceeding by hearing must be adapted to special circumstances of an indigenous conflict in order to respect all the guarantees included in the effective judicial protection principle. The methodology used was the analysis of the normative (constitutional and legal norms) and jurisprudential (decisions of the InterAmerican Court of Human Rights) frameworks concerning the protection of the rights of indigenous communities.In the end, it was found that the submission of indigenous communities to oral processes or hearings in loco (in the territory of the community) allows the provision of effective judicial protection, by removing existing economic and cultural obstacles, and adapting the hearings to the indigenous needs (appointment of a translator, interpreter, companion, respecting their customs and cultural traditions).Downloads
