Abstract

The reconstitution of facts through evidence, an essential requirement for the effectiveness of judicial protection of law (art. 5o, XXXV, of the Federal Constitution), should be as close as possible to the reality of life. Nevertheless, there are more relevant constitutional values that impose limits on the search for the truth, justifying the inadmissibility of illegal evidence (section LVI of article 5 of the Constitution of the Brazilian Republic). In this direction, essentially using the bibliographic review method, the objective of the present text is to address the theme of illegal evidence, presenting guidelines for the admissibility of the evidence in the light of the primacy of fundamental rights, through a balance between the prohibition of illegal evidence and the protection of some fundamental right that is more relevant from a human point of view or public interest, with the application of the principle of proportionality. At the end, an invitation is presented to the application of the guidelines suggested in the resolution of countless situations of the admissibility of evidence involving collision of fundamental rights, as well as the improvement of the subject by the scholars of procedural law, through the re-discussion of the system related to illegal evidence.
