The (i)legality of the prohibition in a condominium resolution of the economic exploitation of residential units for short-term stay purposes

Background: The use of applications that make residential properties available for short-term rentals, such as Airbnb, is becoming increasingly widespread among Brazilians, especially among those who own properties in tourist and high-turnover areas. It is becoming common for people to offer their residential properties, inserted in condominium buildings, on these platforms, allowing travelers to stay cheaper than in hotels and allows property owners to earn extra income. Due to the high turnover of third parties in condominiums, some of them began to prohibit residential units from providing this service, claiming to preserve the security and peace of the other condominium occupants. This fact is increasingly brought to the Judiciary, which demonstrates the need for an academic reflection on the subject. Result: This article intended to answer the following question: would it be legitimate to prohibit, in a condominium agreement, the economic exploitation of residential units for short-term stays, made available through applications such as Airbnb? Method: The dialectic method and the dogmatic legal methodological approach were used, bringing the recent position of the Superior Court of Justice on the subject, in addition to contemporary doctrinal teachings. Final considerations: confirmation of the illegitimacy of the fence imposed by the condominiums.
