Protocol for prior, well-informed consultation and free consent as a legal strategy in the face of threats to the quilombola territory of São José de Icatu-Mocajuba/Baião – Pará

The general objective of this article is to reflect on the process of implementing the Prior Consultation Protocol for the Quilombo Community of São José de Icatu-Mocajuba/Baião/Pará, through a bibliographic review and documentary analysis with a qualitative approach and an exploratory case study method. In addition, in loco records of the community and writings are also used based on an Afrocentric methodology. Among the main barriers to the Protocol being implemented in the remaining Quilombo communities, based on the case study, is the fact that even with the implementation of the Prior Consultation and Free and Informed Consent Protocol approved in the Quilombo Community of São José de Icatu in January 2023, rights are still not respected, incurring the need for a public hearing due to the prior refusal of the municipal authorities to sign a term of commitment to the Protocol.
