The article deals with the process of formal and real subsumption of the State to capital, having as one of the fundamental axes the evolution of war. The aim is to articulate the object in its logical and historical dimensions based on the exposition of Capital, which, it is hoped, will serve as a basis for the analysis of phenomena that range from legal fetishism to the links between Welfare and the Warfare State, passing through the patterns of State intervention in the economy, as well as to sustain the relevance of the Marxian critique of the State and the Law.
