The discursive production of identity and difference
post-structuralist contributions to thinking about law

The article revisits the theoretical and epistemological trajectory of post-structuralism and resulting movements on the discursive production of identity and difference, with the aim of offering other tools for analyzing the concrete demands of subjects and groups for recognition and rights today. By focusing on the praxis and discursive strategies of racialized, gendered and hyphenated subjects, it is clear that such an approach contributes to identifying and problematizing oppressions that are often unfamiliar to the traditional grammar of official law.
