O PAPEL DOS CARTÓRIOS EXTRAJUDICIAIS NA EFETIVIDADE DO ACESSO À JUSTIÇA NO BRASIL

This article examines the overload of the Brazilian Judiciary and the difficulties in accessing justice, highlighting extrajudicial notary offices as one of the essential contemporary means and instruments in the process of dejudicialization. Based on constitutional and procedural principles, from access to justice to efficiency, the study demonstrates that these bodies have played a central role in carrying out acts such as inventories, consensual divorces and land regularizations, contributing to the improvement and strengthening of the legal system. This is an approach in which the Judiciary and Notary Offices go hand in hand and in the same direction, that is, institutional strengthening. However, they still face significant challenges, such as inequality in territorial distribution, the lack of standardization in the training of professionals and economic barriers that restrict universal access to the services offered. Using a qualitative methodology and bibliographic analysis, the research analyzes how extrajudicial notary offices promote access to justice in Brazil, evaluating their benefits and limitations and proposing strategies to increase their effectiveness. Based on legislation such as Laws No. 11,441/2007 and No. 13,465/2017, in addition to academic and legal sources, the study offers subsidies for strengthening the Brazilian legal system, aiming at greater social inclusion, efficiency in the provision of jurisdiction and free access.
