THE PRELIMINARY ADJUDICATION IN THE COOPERATION AGREEMENTS HOMOLOGATION PHASE: CONTROL LIMITS ACCORDING THE ART. 3-B, § 4, OF LAW NO. 12.850/2013

In this article, based on a literature review, the judicial control in the homologation phase of cooperation agreements is analyzed. Although Law n. 13.964/2019 has substantially changed the mechanism, detailing the judge proceeding in the homologation phase, notably related to the need to verify the formal aspects of the agreement - regularity, legality, adequacy and voluntariness -, it failed to detail the limitsto the preliminary judgment. This entails risks to the binding of the judge, at the time of sentencing, regarding the terms of the homologated agreement. The general objective is limited to the analysis of the spaces of action of the judge on the merits of the pacts established between prosecution and defense. Therefore, we aim to answer the following problem: what are the limits of judicial review on the merits of the cooperation agreement at the time of its homologation? After establishing the judge powers at this phase, we will argue that the homologation must verify, in a superficial analysis, the factual basis, the crime charged and the relevance of the cooperation in order to be submitted to it in the sentence.Downloads
