Abstract

The main purpose of this study is to assess the legal effects of the principle of joint and several liability on the procedural model based on the principle of procedural cooperation. However, despite what has been advocated by legal theory, the legal consonance between these two concepts does not result or direct influence, but the incidence of the effects of joint and several liability shall be mediated by procedural good faith, which, once it is incorporated into a cooperative model, ends up disseminating the effects of the principle of joint and several liability. Therefore, the thesis presented herein sought to demonstrate a distortion of the existing scientific view regarding the direct correlation between the two concepts, in order to structure and organize the legal compliance of both, according to a hermeneutic-philological methodology. As a result, the limits of the effectiveness of the principle of joint on the procedural cooperative model were identified.
