Housing policies and personality rights: a trajectory between advances and setbacks

The present work analyzes the evolution of Brazilian housing policies, focusing on the National Housing Bank (BNH) and the Minha Casa Minha Vida Program (PMCMV), from the perspective of the right to housing as a personality right. The objective is to understand the advances and setbacks in the realization of this fundamental, social and personality right. The bibliographic and documentary research method was used, with qualitative analysis of articles extracted from databases such as: Scielo, Ebsco and Periódicos Capes. The justification is based on the need to understand the right to housing beyond its prestational dimension, incorporating aspects such as privacy, security and personal development. Methodologically, it articulates bibliographic review, historical-institutional analysis and quantitative evaluation of PMCMV data. The conclusions show that, although PMCMV represents advances in scale and technical sophistication, subordination of social objectives to economic interests persists, perpetuating regional inequalities. The research proposes conceptual reformulation of housing policies oriented by human dignity as an irreducible core, transcending quantitative approaches to incorporate qualitative dimensions essential to personality rights.
