Peripheral urbanization, self-construction and sustainability: analysis of TJSC judicial decisions that deny the provision of public services

This paper analyzes the judgments of the Court of Justice of Santa Catarina (TJSC), published between January 2015 and March 2023, regarding the provision of essential public services — such as providing electricity, drinking water, and sewage collection — to housing considered illegal by law. The selection of decisions was carried out based on the frequency deduction method. The central objective of the research is to verify whether the judicial decisions analyzed ensured the right to a sustainable city. To meet this purpose, first, the historical process of construction of urban spaces in Brazil in general and in particular the city of Florianópolis, is examined, demonstrating how socio-spatial segregation has structured Brazilian cities since their origin. Addressing the importance of popular counterpoint in urban construction and in the legal guarantee of the right to the city, the result of a pluralist perspective of law. Next, an analysis of the concept of sustainability and its intersection with the right to the city. Finally, presenting the result of the research carried out in the jurisprudence of the TJSC, which has been systematically denying access to public services and, consequently, the right to a sustainable city.
