Abstract

The objective of this work is to explain how the jurisprudence of the Inter-American Court of Human Rights (Inter-American Court) has impacted the evolution of the constitutional and conventional control system in Mexico, based on the analysis of some contentious cases, namely, that of Jorge Castañeda Gutman and Rosendo Radilla Pacheco against Mexico. Likewise, a prospective exercise will be carried out on the implications of the ruling by the Inter-American Court, in the cases of Txompaxtle Tecpile and others Vs Mexico, and García Rodríguez and another Vs. Mexico, in the evolution of the so-called control of conventionality.

For the development of this manuscript, legal methods will be used: dogmatic, exegetical and case analysis, with the purpose of explaining and substantiating that the jurisprudence of the Inter-American Court has had a positive impact on the evolution of the control system of constitutionality and conventionality in Mexico, which undoubtedly translates into better conditions for national judges to guarantee the full validity and effectiveness of human rights, in cases where people claim violations of these by public power and of individuals.
