Abstract

The work at hand consists of an analysis of the exegesis of the affirmative action concerning the Quota Law for admission to higher education, Law 12,711/2012, and its amendment by Law 14,723/2023, this being a fundamental instrument to promote equality and the inclusion of historically marginalized groups. To this end, firstly, Law No. 12,711/2012 will be dissected in its form prior to the amendment, and then the changes brought about by Law 14,723/2023 will be analyzed. Next, the aim is to synthesize the main criticisms made of Law 12,711/2012 in over 10 years of its existence, and what has or has not been done to address them through Law 14,723/2023. The study consists of an exploratory research: in order to enable a qualitative methodological investigation of the data, the chosen approach was bibliographical research: doctrines, jurisprudence, articles, data from the Brazilian Institute of Geography and Statistics (IBGE), and other sources capable of producing the expected results were analyzed.
