Abstract

In view of the current scenario of decision-making divergence between Courts of Justice and Appeals Panels of Special State Courts, this article seeks to offer a solution to the legal uncertainty caused by the absence of mechanisms of jurisprudential standardization between both entities. In this sense, by the hypothetical-deductive method, we propose the extension of the legal thesis held on the Incident of Resolution of Repetitive Demands (IRDR) to the Special State Courts, to be made possible by means of a complaint. Therefore, it is necessary to briefly analyze the creation of the Special Courts, the deficiencies of their decision-making system and the IRDR institute, through the doctrine and jurisprudence developed in this regard. The article concludes with the proposal to extend the limits of the IRDR to serve as a standardizing bridge between ordinary justice and the microsystem of State Special Courts.
