Resúmen
El presente artículo constituye una crítica a la Ciencia y al Derecho sometidos a la técnica moderna, que en su desarraigo del conjunto de relaciones culturales y éticas de los diversos pueblos a los cuales afecta, y voluntariamente ajenos a cualquier otro criterio que no sea ellos mismos han devenido en sistemas autónomos sometidos a lógica implacable de la eficiencia. El Derecho se ha visto reducido a la técnica; en el mejor de los casos, para regular relaciones entre personas, y en el peor, como técnica de dominación política y económica de las mayorías empobrecidas. Es por lo anterior que en este trabajo se realiza una crítica a las bases epistemológicas y jurídicas sobre las que se construye el mundo moderno/colonial, esto es, el papel de la Ciencia y el Derecho en la construcción de la modernidad capitalista a partir de una doble lógica reduccionista engarzada para crear una férrea dominación jurídico/epistemológica que descalifica e ilegaliza la producción epistemológica y jurídica desde los procesos populares. Desde éstos se cuestiona la relación saber-poder impuesta desde la concepción autoritaria de la ciencia y la legitimidad del poder estatal como único productor válido de Derecho, optando por desmarcarse de las lógicas impuestas, y creando y recuperando su propio Derecho y sus propias formas de conocimiento desde los procesos populares.

Abstract
This article is a criticism of the Science and Law under modern technology, which in its uprooting of all cultural and ethical implications of the various peoples which affects relationships and willfully oblivious to any criteria other than themselves they have become autonomous systems under relentless logic of efficiency. The law has been reduced to the art; in the best case, to regulate relationships between people, and at worst, as a technique of political and economic domination of the impoverished majority. It is for this that in this work a critique of the epistemological and legal basis on which the modern / colonial world is built is made, that is, the role of science and law in the construction of capitalist modernity from double crimped reductionist logic to create an iron law / epistemological rule that disqualifies and outlaws the epistemological and legal production from popular processes. From these questions the relationship knowledge-power imposed from the authoritarian conception of science and the legitimacy of state power producer as the only valid law, choosing to distance themselves from the logic imposed, and creating and recovering its own law and its own forms of knowledge from popular processes.
