Abstract

Resumo

O artigo pretende evidenciar a articulação presente em uma parte da obra de Foucault, referente à primeira metade da década de 70, considerando algumas formas de constituições de sujeito na história, os saberes, os efeitos de verdade e o papel que as práticas judiciárias tiveram nesse processo. Nesse sentido, pretende-se utilizar, principalmente, as conferências apresentadas na PUC do Rio de Janeiro e em seu primeiro curso no Collège de France. Cumpre ressaltar que o direito, examinado como prática jurídica, não deve ser entendido como uma instância absoluta, mas que se rearticula e promove revoluções no conhecimento, constituindo novas noções de sujeito absoluto e, consequentemente, de verdade.

Abstract

The article aims to evidence the articulation present in one part of Foucault’s work, referring to the middle of 70 decade, considering the different constitutions of the subject in the history, the knowledge, the effects of truth and the role that the judicial practice had in this process. Thus, it aims to analyze, mainly, the conferences presented at PUC RJ and in his first course of Collège de France. It should be emphasized that the right, examined as a juridical practice, should not be understood as an absolute instance, but that rearticulates promotes revolutions in knowledge, establishing news concepts of absolute subject and, therefore, of the truth.
