Abstract

The paper aims analyzes the need to identify a method for carrying out an association between different legal systems to achieve competent results. Thus, the expert must identify constant elements to what intends to research, so that legal systems can be compared. The omnipresent element to enable a true comparation is known as tertium comparationis, namely the quality that two things or facts must hold if they are to be effectively compared. It concludes, from as intense debate motivated by some examples, that the tertium comparationis must always be present in the comparative assignment in order to provide the comparator with an awareness of the results to be achieved.
