The right to the city in the case law of the TJPR: an attempt to compile and systematize its decisions (1988–2023)

The "right to the city" is an urbanistic expression of human dignity and public interest which encompasses fundamental rights with spatial implications, identifying with the accessibility/participation binary. This study aimed to systematize final decisions on merit in civil appeals judged by the Parana State Court of Justice between October 5, 1988, and December 31, 2023, where this expression was explicitly used. An inductive-interpretative method was adopted through quantitative-qualitative research of a documentary/bibliographic nature, having secondary data from bibliography related to the theme and primary sources in legislation and decisions collected on the Parana State Court of Justice website, adopting the cited expression in the search. The quantitative analysis was based on nine indicators (temporal and spatial distribution; type and author of the action; matter discussed; procedural subject that inserted it in the records and the context in which this occurred; recognition of the fundamental nature and centrality of the "right to the city") that allowed systematizing the judgments according to the matter discussed, analyzing their content. Among the main results are the analytical validity of the aforementioned binomial and trends of the Parana State Court of Justice in judging cases adopting the expression. Finally, contributions were provided for future studies considering, for example, the use of this expression by other courts and decisions that had used these related expressions.
