Urban Usucapion and the Right to Housing: a case study on disputes over the right to the city based on legal actions against Usina Trapiche

This article investigates the Right to Housing and urban adverse possession as instruments of land regularization, focusing on specific judicial processes against Usina Trapiche S/A currently pending in the Pernambuco State Court. The objective is to analyze the relationship between the exercise of the right to decent housing and the declaration of adverse possession. The adopted methodology follows an inductive and qualitative approach, using a case study as a research strategy to understand the complexity of the phenomenon of urban adverse possession in a real context. The specific analysis of the mentioned legal actions allows an in-depth investigation of the processes. Specific results were found on the positive and negative aspects of adverse possession, including the duration of the legal process, the time between procedural stages, and the production of evidence. These results highlight the challenges and possibilities of overcoming judicial bureaucracy, aiming for a more efficient formalization of housing. This study contributes to understanding the dynamics of urban adverse possession, offering perspectives that can assist in the formulation of public policies and in improving judicial processes related to land regularization, thus promoting the right to decent housing more effectively.
