Recent public policies on special education from the perspective of inclusive education and Human Rights have contributed to the increasing enrollment of students with disabilities in higher education. This scenario has raised in these institutions the need for a restructuring that contemplates the fulfillment of the specificities of these students. In this sense, understanding that accessibility is a fundamental human right of people with disabilities, this study aims to present the importance of the process of consolidation of special education policies from an inclusive perspective and Human Rights in higher education. To this end, a bibliographic research was developed, through the state-of-the-art methodology and the literature review based on the references that deal with this theme. The data were analyzed in view of the assumptions of qualitative research and indicated that special education policies from the perspective of inclusive education and human rights in higher education corroborate the understanding of accessibility as a fundamental human right in the process of inclusion of people with disabilities in these spaces.
