The paper presents the conceptual bases for a Marxist critique of relations between states from the perspective of global capitalism, proposing a critical re-reading of the debate about the state form in the Marxist tradition from the point of view of the Althusserian theory of the state, which is presented in the form of a theory of ideology. It deals with interstate relations by returning to the text of Capital, with the aim of demonstrating that Marx laid the foundations for understanding relations between states in contemporary global capitalism. To this end, it makes the methodological points necessary to understand the debate in all its potential, and points out the divergences between schools of Marxist critique of law, which adhere to or reject the derivationist framework.
