Resumo
Entre a fase de redemocratização das sociedades latino-americanas até os dias de hoje, os Estados da região apostaram no direito penal como um importante instrumento de enfrentamento ao racismo estrutural. Diante da consideração das teorias biopolíticas de Foucault e de Agamben, que analisam a raça como uma estratégia de formação das identidades nacionais embasadas em hierarquias, o presente artigo busca refletir sobre os limites do direito penal como mecanismo eficaz de enfrentamento ao racismo estrutural dos países da América Latina.

Abstract
Between the phase of redemocratization of Latin American societies until the present day, the states of the region have bet on criminal law as an important instrument to confronting structural racism. Considering the biopolitical theories of Foucault and Agamben, who analyze race as a strategy for the formation of national identities based on hierarchies, the present article aims to reflect on the limits of the criminal law as an effective mechanism to fight against the structural racism of Latin American countries.
