Temporality and Overruling
in search of criteria for the stability of jurisprudence

Overruling is an essential technique for the functioning of a precedent system. However, the Brazilian system has certain peculiarities that pose specific challenges to this institution. One of these challenges arises from our model of concentrated formation of precedents, especially in the higher courts, considering that overruling is only possible by the body that created them. In this sense, barriers to accessing the higher courts, such as those provided in art. 1,030 of the CPC, may be an obstacle to overcoming any outdated precedent. However, they serve a very important purpose in stabilizing case law, as determined by art. 926 of the CPC. This paper, therefore, seeks to identify criteria for a balance between the two values, protecting the stability of case law and established precedents, while at the same time providing ways to overcome outdated guidelines. The main conclusion lies in the aspect of temporality, which must be considered based on the increase or decrease in the burden of argument of those who intend to see this or that precedent overcome.
