Abstract

This article addresses the growing influence of Artificial Intelligence (AI) in the processes of Alternative Dispute Resolution (ADR) and Online Dispute Resolution (ODR) within the context of the Spanish legal system. It begins by discussing the social transformation driven by algorithmization and the fourth industrial revolution, which has introduced significant changes in various spheres, including law.  It explores the implementation of AI-based systems in the judicial environment, highlighting their advantages and challenges. It emphasizes the European Charter on the Use of Artificial Intelligence in Judicial Systems, which provides guidelines for the ethical and efficient integration of AI. The author analyzes Spanish regulation on the use of AI in justice, underscoring the need for a balance between technological innovation and the protection of fundamental rights. Furthermore, it examines mediation and data-driven justice, addressing the challenges and opportunities for ADR. It discusses how AI can enhance efficiency and accuracy in dispute resolution, but also raises concerns about fairness and data privacy. Regarding ODR, the article discusses its benefits of accessibility and convenience, especially in an increasingly digitalized world.
