ATOS PROCESSUAIS POR MEIOS ELETRÔNICOS E REFLEXÕES SOBRE A CITAÇÃO POR WHATSAPP

The present term paper aims to scrutinize procedural acts implemented by electronic means. As follows, the research investigation method is classified as bibliographical, normative, and jurisprudential, with qualitative analysis and also a purpose to understand the evolution of new technologies applied by the Judiciary regarding court summons, a communication procedure of vital importance. As primary sources, both resolutions and recommendations from the National Council of Justice are examined. Additionally, the survey embraces the impact of Law Nº. 14.195/2021, which significantly modified the Code of Civil Procedure’s approach to the service of summons. Furthermore, the potential benefits reached by adopting technology for summons are analyzed; in parallel, pressure points related to alterations are contemplated, particularly concerning technological obstacles and the guarantee of access to justice for those who are digitally excluded. Finally, it outlines the form-mode*[1] process of conducting remote and synchronous procedural acts employing the instant messaging service WhatsApp, spotlighting legal foundations for the technical defense of the study results.
[1] form-mode: a neologism created by the author based on Italian jurist and lawyer Francesco Carnelutti´s viewpoints about uses of words "form" and "mode" in the Civil Procedure Code.
