Abstract

The present article aims to discuss the legitimacy of atypical indirect executive measures within the scope of execution proceedings for right amount, specifically the suspension of the debtor’s driving license and passport apprehension, when patrimonial research and attachment of assets prove to be ineffective. The study is conducted using dogmatic research, instrumental and bibliographical techniques, seeking in STJ's jurisprudence to delimit the applicability of article 139, IV, of Brazilian Code of Civil Procedure in relation to the constitutional principles of Brazilian legal system. It is concluded that the jurisprudence of the Superior Court of Justice recognizes the need to meet doctrinal and principle requirements, however there is a deficit of reasoning. This is why the following criteria are suggested: the subsidiarity of such measures; of the way in which this determination would be useful for the satisfaction of the credit; of the least onerous measure to the executed; the dignity of the human person; and the constitutional duty of judicial reasoning.
