Questões controvertidas sobre a impenhorabilidade legal do bem de família

Law 8.009/90 established in Brazil the unseizability of the family home, prohibiting its seizure for any type of civil, commercial, tax, social security or other debt. Since it came into force, a number of controversies have arisen regarding its application. The aim of this paper is to address the main issues relating to the legal family asset. The protection is directed at the family home, which is the place in the city that guarantees the free development of the personality and the coexistence of its members. The doctrinal and jurisprudential solutions to the controversies involve conflicting constitutional rights. On the one hand, the principles of the Social Function of Property (art. 5, XXIII), the Social Right to Housing (art. 6), Social Solidarity (art. 3, I) and the Dignity of the Human Person (art. 1, III), on the other, the principles of the Autonomy of Will (art. 170), Free Initiative (arts. 1, IV and 170) and Private Property (arts. 5 and 170, II). The institute has enormous social reach and offers protection to families in situations of economic crisis in cities, preventing the concentration of urban residential property in the hands of only the most privileged classes.
