À PORTA DA LEI: A VIGÊNCIA SEM SIGNIFICADO DOS DIREITOS HUMANOS E SOCIAIS NO ESTADO DE EXCEÇÃO / THE DOOR OF LAW: THE TERM WITHOUT MEANING OF HUMAN RIGHTS AND SOCIAL IN THE STATE OF EXCEPTION

Este trabalho pretende ampliar a discussão sobre o estado de exceção na atualidade, traçando uma abordagem sobre o lugar dos direitos humanos e sociais no vazio de direito instaurado pelo estado de exceção. A pesquisa tem por referencial teórico as pesquisas desenvolvidas por Giorgio Agamben nesse sentido. Observa-se que a história da República de Weimar carrega a incongruência de uma Constituição – cujo prestígio aos direitos sociais conferia-lhe condição referencial –, a despeito da qual foi permitida, por seu art. 48, §2º, a ocorrência dos eventos tão ignóbeis que marcaram o século XX. Nesse cenário, sobreleva-se a relativização dos direitos humanos pela política norte-americana no pós-11 de setembro. A suspensão da ordem vigente tornada possível pela luta contra o Terror escancara o vazio instaurado pela exceção, na suspensão dos direitos humanos. As manifestações do estado de exceção na realidade brasileira também serão abordadas, a fim de apontar em que medida os direitos fundamentais podem ser fragilizados. O intento é mostrar que as situações (que deveriam ser) excepcionais impõem à lei uma pura vigência significado, em outros termos, uma abertura que, como na lenda kafkiana, impede a própria entrada.
