THE NON-TRANSCENDENCE PRINCIPLE OF THE SENTENCE AND SOCIAL LABELING ON THE CHILDREN OF WOMEN IN DEPRIVATION OF LIBERTY

This work aims to demonstrate the reality of female prisons and the violations of rights that happen in these places, mainly, regarding the exercise of motherhood. Prisons were not designed to receive women, and the social stigma on them resulted in their abandonment within these institutions. Thus, women often serve their sentence without visitation and their incarceration compromises the entire family bond, especially the relationship with their children. In this way, this work seeks to expose how institutions that should protect and guarantee the rights of these women and children act as rights hinderers, and how they expose these children to social labeling, while preventing these women from exercising motherhood. This work seeks to compare legislation and reality, through documentary reports, in order to solve one of the invisible problems of our society: the criminalization of the children of incarcerated women.
